By purchasing or downloading from BirdSings you accept these terms. They apply to buyers worldwide; mandatory consumer-protection rules of your country of residence are not waived.
You purchase a personal, non-exclusive, non-transferable, worldwide license to use the MP3 file for hunting (where legal — see Disclaimer), bird identification, training, ringtones, or personal listening. Redistribution, resale, sublicensing, public broadcast, or commercial use (TV, radio commercials, paid training products, AI-training datasets) is prohibited without a separate written license.
Files are delivered as MP3 at 320 kbps, immediately after payment, via a signed URL valid for 12 hours. Unlimited download attempts within that window are allowed, but the URL locks to the first IP address that uses it. Re-issue requests after expiry are handled case-by-case at support@birdsings.com.
Every file contains an inaudible watermark tied to your purchase. If the file appears on a piracy site we can trace it back to the order. Sharing the file is a breach of these terms and may give rise to claims under applicable copyright law (e.g. EU Directive 2001/29/EC and national implementations, US DMCA, UK CDPA 1988, Greek Law 2121/1993, equivalents).
Service provided "as is". We do not warrant uninterrupted availability. Maximum aggregate liability per dispute is the amount you paid for the file in question. We are not liable for legal or hunting outcomes related to file use. Nothing in these terms limits liability that cannot be excluded under your local law (e.g. for death, personal injury, gross negligence, or fraud).
These terms are governed by the law of Greece (Hellenic Republic). The competent courts of Athens, Greece have jurisdiction, unless you are a consumer resident in another country whose law gives you the right to sue in your home courts under their consumer-protection rules — in that case those rules apply and that right is preserved.
EU consumers may also use the European ODR platform. UK consumers retain rights under the Consumer Rights Act 2015.
We may update these terms. Material changes will be announced on the site banner at least 30 days before taking effect. Continued use after the effective date counts as acceptance.
